Terms and Conditions
Description of Service
The service allows you to send SMS messages from the website and access to the online mobile community via the internet. To use this service you need a valid mobile number & Smsfun account in one of the countries supported. You are not sent any bills, invoices or statements.
Changing the Agreement
We will provide the service to you on a non-fixed length agreement until it is cancelled in accordance with the agreement. Smsfun may change the agreement by providing members affected by the change 14 (fourteen) days notice through email or online notification for non-billing related changes.
Personal Information
Personal information about you includes name, address, mobile number and account useage data. We may collect, use and disclose information about you in the following circumstances: (a) To decide whether to start, stop or limit supply of services or products. If you do not supply this information we may refuse or limit the supply to you or the service. (b) For purposes related to the supply of services including management, business planning, product development. (c) To provide you with information about promotions.
We may be required or permitted by law to collect, use or disclose personal information about you from and to, for example: emergency services and law enforcement. Smsfun is not in the habit of giving your information out freely and will not do so under company policy. Your information is never shared or sold to third parties.
Fool your Friends
The SmsFun fool your friends feature is for entertainment purposes only and must not be used in bad faith. All messages from this service are user driven (p2p) and although Smsfun does screen out some names from being used, we cannot monitor this service to check for every message sent. Smsfun reserves the right to hand out information to law enforcement agencies should any SMS passing through the SmSfun gateway system raise suspicion.
Refunds and Cancellations
You can cancel your account online at any time by proceeding to http://www.smsfun.com.au/cancel.php. You will need to verify your account details and confirm cancellation. Smsfun does not issue refunds unless a billing error has occurred, however if for any reason you feel that you are entitled to a refund, please use the contact methods below. Keep in mind Smsfun does heavily record all movement and tracking data and extensive web and mobile logs are kept on file.
PSMS Blocks
If Smsfun detects that you have a PSMS (premium sms) block on your mobile account with your provider, SmsFun may opt to cancel or suspend your account until such time as the block is removed. This does not mean you will be billed or have been in the past however it prevents abuse of our system.
Other information
Costs are billed to your mobile phone account by your carrier. It is your responsibility to ensure your mobile account has sufficient credit to accomodate SmsFun messages. SmsFun takes no responsibility for any misuse or over-subscribing to services of members. If you are under 16 years of age you must have the bill payers permission to subscribe to any SmsFun services.
Cancellations:
To halt sms alerts from SmsFun, send a text message with STOP, to 19767386 or 19767565.
!!WARNING!! If you cancel sms alerts using this method, you will lose all access to alerts in your account and your SmsFun membership may be terminated. To avoid this, log in to your SmsFun account and deselect the services you no longer wish to receive updates/alerts on. This will ensure your account remains open and you can continue sending Free Sms and the other fine services of SmsFun.

While legally you may not be required to pay your mobile bill, your parent or guardian definately is. Smsfun logs every request for content, membership, pictures, server and database query with ip, geo-ip and proxy detection features. Should any charges be disputed by the bill payer, Smsfun reserves the right to persue the user via legal and civil avenues for moneys owed, damages, legal costs and ongoing hardship to SmsFun from any false or misrepresented claims arrising from any disputed matter. SmsFun may call to verify mobile ownership to any members under 16 years of age.
